The Court found that the Republic of Chad failed to comply with its obligations under Article 97 of the Rome Statute to cooperate with the Court regarding the arrest and surrender of Omar Al-Bashir. The Court refers its decision to the UN Security Council and the Assembly of States Parties.

Arrested and extradited to the ICC in January 2011. In December 2011, the Court dismissed the charges due to insufficient evidence and he was released.
