I Think that there is a question whether Hamas in fact did commission the attacks as a whole remains unanswered. And whether Israel in fact did commission their attacks is answered in full as a whole.

In my opinion due to the conflict rising from the lead attack alleged to be from Hamas Command directly, without answering the first question, there remains to be a balance to consider between Israel and Palestinian state whether Israel is to be considered the aggressor and reason the conflict continues alone, furthermore, there remains to be questions whether the Palestinian people have an inherent right to refuse access to their state as Israel is invading includes their Israelite people.

It is subject for the court to reveiw in my opinion whether an Israelite population is an occupartion legal prior the attack or a use of force by an unelected state entity, in which case i refer a reference to the Ukranian Russian conflict as is a Question that remains there whether russians that werre know to reside there on Ukrainian soil can call for aid from their parennt state to be protected. which is not the situation of the people of palestine, Palestine has been used by muslims and christians for thousands of years not needing the kings of Israelite forces.

I also wonder if Hamas does have jurisdiction to sign the rome statute provides the jurisdiction the icc then possess or does Israel allege they do not rule which would create an impossable situation as would then be clear genocide.
